It's Taim online shop terms of use

1. General

1.1. Current terms and conditions of sale (terms) of It's Taim online shop (online shop) apply when buying from It's Taim online shop at https://itstaim.ee/ web address. The seller of products is It's Taim OÜ (seller), address: Tindi 6-1, Tallinn, 13516, Estonia, registry code: 16195980, phone number: +372 56385311, e-mail address: its.taim.ee@gmail.com. Terms set forth a legally binding agreement between any person (customer) and seller, when buying products via It's Taim online shop.

1.2. Seller has the right to unilaterally change and augment the terms, publishing updated terms at  https://itstaim.ee/terms-of-use web address. Changes do not apply retroactively.

1.3. Customer may save the terms before making a purchase, print and present in the case of need. Customer agrees to the terms when making a purchase from the online shop.

1.4. In addition to the terms, legislation in force in the Republic of Estonia applies to making a purchase from the online shop.

1.5. Seller reserves the right to reject the purchase of ordered product in following cases:

1.5.1. the price or description of the product is incorrect due to a human or technical error;

1.5.2. product ordered by the customer is damaged or unavailable.

2. Buying products and placing orders in the online shop

2.1. Customer can place orders in the online shop as a guest.

2.2. Customer selects desired products from the online shop and adds them to the shopping cart.

2.3. Customer chooses the place and method of handover.

2.4. Customer confirms the shopping cart and pays for the products in payment environments, offered by the seller. Before making the payment, customer verifies that data presented in the bill corresponds to the customer's actual wish.

2.5. Order has to be paid straightaway. Order is considered placed after the payment is made.

2.6. After the successful payment, customer needs to press "Back to the seller" link.

2.7. Seller sends a receipt for the purchase to the customers e-mail address.

2.8. Sales agreement between the seller and the customer apply from the moment when full payment for the order arrives to sellers bank account.

2.9. Seller returns the money for products that could not be assembled as soon as possible, but not later than 14 days.

2.10. If customer has paid for an order and wishes to change it, this can be done by withdrawing from the sales agreement within 30 days and placing a new order.

3. Product prices and payment options

3.1. All product prices in the online shop are shown in euros and do not contain VAT.

3.2. Customer pays the sale price of the goods and the delivery fee in full in advance. Online shop payments are mediated by EveryPay AS. When paying with a bank link, the transaction takes place in the secure environment of the respective bank, when paying with a credit card it takes place in the secure environment of EveryPay AS. When making a payment, the recipient of the payment is EveryPay AS. EveryPay AS is not a party to the sales contract concluded between the customer and the . The seller does not have access to the customer's bank and credit card details.

3.3. The delivery price is added to the sales price in accordance with clause 4 of the terms.

3.4. Payment can be made in the ways shown in the online shop. A service fee may be added to the cost of the order in accordance with the agreement concluded between the customer and the issuer of the bank or credit card.

4. Delivery and handover of products

4.1. The goods can be ordered either to a parcel machine or to the address indicated by the customer using courier service.

4.2. Receiving the goods from a courier:

4.2.1. If the customer wants the goods to be delivered by courier, the courier will deliver the ordered goods within 2-5 working days from the confirmation of the order. If the customer chooses the courier service for the delivery of the goods, a delivery fee will be added to the price of the goods, starting from 3€ in Tallinn and its surroundings (Viimsi, Peetri, Laagri, Harku, Tabasalu) and starting from 12€ in the rest of Estonia. Delivery service fee depends on the size, weight and delivery area of ​​the ordered goods.

4.2.2. The goods are delivered to the customer's front door, which also applies to apartment buildings.

4.2.3. If the start of the delivery time falls on a weekend or public holiday, the order will be delivered on the following working days.

4.3. Receiving the goods from a parcel machine:

4.3.1. If the customer chooses parcel machine as method of delivery, a delivery fee of 4€ will be added to the price of the goods. The delivery fee depends on the volume of ordered goods. Maximum parcel size that can be delivered to a parcel machine is 37 cm (height)*35 cm (width)*59 cm (length) with a maximum weight of 30 kg.

4.3.2. The purchased goods will arrive at the parcel machine within 2 working days from the confirmation of the order.

4.3.3. The customer is notified of the arrival of the goods at the parcel machine by an SMS message, which contains a unique door code for opening the parcel machine door. SMS notifications are only sent to Estonian phone numbers.

4.3.4. The seller is not liable for the damage caused to the customer if, for reasons beyond the seller's control, third parties have received the unique code of the parcel machine and the goods have been received on the basis thereof.

4.3.5. If the customer has not collected the goods from the parcel machine after the deposit period, the seller considers that the customer has canceled the order, and returns the purchase amount to the customer as soon as possible, but not later than within 14 calendar days, to the same bank account, from which the purchase was made. Shipping costs will not be refunded to the customer.

4.4. Product control

4.4.1. Upon receiving of the goods, the customer undertakes to open the product packaging carefully, without damaging the packaging and products. If the customer has damaged the packaging due to negligence, ie the product packaging could be opened without damaging it, the seller has the right to demand compensation for the damage caused when the goods are returned. If the product packaging cannot be opened undamaged, the customer is not responsible for the damaged packaging.

4.4.2. Upon receiving of the goods, the customer undertakes to immediately check the quantity of the goods and their compliance with the order and to sign the delivery note. If the customer notices upon receipt of the goods that the goods do not correspond to the order, the data indicated on the delivery note or the packaging and products have significant damage, the customer must immediately notify the customer support of the online shop.

4.4.3. If upon receiving of the goods, the customer discovers that the wrong or defective goods have been sent to him or that the goods do not reach the customer in good condition and in a sealed package, the seller's customer service must be notified immediately.

4.4.4. The seller is responsible for the goods purchased by the customer during its transportation. From the moment of handover of the goods, the risk of damage or loss of the goods passes to the customer.

5. Processing of personal data

5.1. The customer grants the seller the right to process and store the personal data entered by them. The seller uses the personal data entered by the customer only to fulfill the order, to solve problems encountered during the execution of the order, to conduct market research of the company, to design new services and service pricing, and to inform about the service provider news. The seller confirms that all personal data of the customer is treated as confidential information.

6. Withdrawal from the sales agreement and refund of goods and payments

6.1. The customer has the right to withdraw from the sales agreement made in the online shop and return the goods purchased from the e-shop within 30 calendar days from the receipt of the goods.
If the goods are returned, the seller's customer support must be contacted and an agreement reached.

6.2. In order to withdraw from the sales agreement and return the goods, the customer must submit a withdrawal application within 30 days of receipt of the goods and forward it by e-mail: its.taim.ee@gmail.com.

In the withdrawal application, the customer provides the following information:

  • order number
  • the date of receipt of the goods
  • customer's name
  • name of the returned goods

6.3. When exercising the right of withdrawal, the customer is obliged to return the goods to the seller no later than within 14 days as of the submission of the withdrawal application.

6.4. The customer may exercise the right to withdraw from the contract if the goods are unused and undamaged. We recommend the customer to return, return or deliver all the goods he wants at once. The direct costs of return are borne by the customer.

6.5. If the customer has withdrawn from the transaction, the seller shall return the purchase amount to the customer together with the delivery fee as soon as possible, but not later than within 14 calendar days from the date of return of the item or proof of return. Refunds will be made to the same bank account from which the purchase was made.

6.6. If the customer has damaged the returned goods intentionally, or due to negligence, the seller has the right to refuse to take back the goods or demand compensation for the damage caused.
